These Terms and Conditions are applicable to Astrologers who sign up on Anytime Astro for providing online advice and professional consultation. When you sign in as an Astrologer, you are directly contracting with Innovana Astro Services Ltd. These terms and conditions of use (Terms & Conditions) as a whole or part legally binds Astrologer Advisors (referenced herein with "You" or "Your") and Anytime Astro, a product of the company Innovana Astro Services Ltd. (referenced herein as "Anytime Astro", "We", "Our", "Us", "Company") with regards to the use of Anytime Astro website i.e. https://www.anytimeastro.com/ (referred to as the "Website") and the services, offered via website or application.

Anytime Astro reserves the absolute right to alter, add, modify or remove some parts of these Terms and Conditions anytime at its sole discretion. It is the responsibility of the Astrologers to check our Terms & Conditions from time to time. If you continue to use the services of this website and Anytime Astro application after the Terms and Conditions are updated, then it implies that you agree with these changes.

By using this website and application, you agree to the below-mentioned Terms Of Use. If you do not agree, do not use this website or any of its services.

1. NATURE AND APPLICABILITY OF THE TERMS

1. These Terms incorporate present Terms and Conditions as well as Privacy Policy. These two combinedly describe the exact legal Terms between You and Anytime Astro.
2. After You sign up on Anytime Astro, the below-mentioned terms will be applicable to you:-
1. You need to prove your specific identity by providing a recent profile image. This picture will be used on your profile and cannot be changed by you. In case you want to replace this Profile Picture, you need to raise a request to Anytime Astro and need approval on picture change request. You cannot use this photo on any other platform or website till these terms exist. If found violating this clause, your profile will be deactivated. When you create a profile on Anytime Astro, you provide Anytime Astro a sole, royalty-free, permanent, irrevocable, international license to
• Utilize, reproduce, change, transfer and display any part of your profile including display pictures, ratings, user reviews, etc. to integrate it in other works in any upcoming or existing form, media, or technology.
• Make your profile visible online as well as offline on the internet, TV, or other print media and use it for marketing, promotional, or branding purposes.
• Make your content visible online or offline through Anytime Astro or other contractors or partners.
2. Your personal identity or information must not be disclosed on your profile. Your display name can only include your first name or the name chosen by Anytime Astro Panel. In case you wish to replace this profile name, you need to raise a request to Anytime Astro. You cannot use this name on any other platform or website till these terms exist.
3. You agree to not misuse your work on Anytime Astro for your personal publicity. Your display name and display picture must not be publicized by you until you get written permission from Anytime Astro for the same.
4. You are prohibited to use the same display image and display picture You used on Anytime Astro on any other platform for a period of 5 years from the termination of your association with Anytime Astro. This association can be terminated by terminating the binding contract and relation with Anytime Astro and discontinuing your profile.
5. Your real name, complete name, or alternate name must not be revealed by you to users. In any type of communication(calls, chats, reviews, comments) on Anytime Astro, you must use your display name only. If found violating this clause, your profile will be deactivated permanently with immediate effect without prior notice.
6. You agree that you have provided all the information true to the best of your knowledge. None of the data provided by you is illegal as per law and regulations. By signing up, you agree that if any information provided by you is found to be false, your profile will be deactivated permanently with immediate effect without prior notice.
3. As a professional Astrologer when you sign up with Anytime Astro, a thorough verification of your submitted information and details is done. If found complying, Anytime Astro will create your profile. Please note that even if you choose to terminate your contract with Anytime Astro, your display name and display image can be shown on this website for a period of 3 years unless your profile has been removed for any violation on this platform.

OBLIGATIONS AND PERFORMANCE

Zero tolerance for Violations

1. You are required to behave cordially with customers of Anytime Astro. Any kind of foul behavior including filthy language, threatening, etc shall not be entertained and may lead to the deactivation of your profile on Anytime Astro for a minimum of 1 week. This period can be extended further. To resume the services you have to provide a written assurance of not to repeat the same violation again.
2. You agree to behave decently and answer all kinds of queries by the customer patiently and peacefully. You are prohibited to make public the personal information of your customers you found through Anytime Astro. In any case, you must not reveal the reason why the customer sought advice from you. If found violating this clause, your profile will be deactivated with immediate effect without prior warning.
3. You agree to maintain the decorum of Anytime Astro. You are prohibited to upload any kind of content which does not comply with the law, is detrimental, can defame someone, is filthy or obscene, can breach the privacy of someone, can be used to harass or threaten someone, can invoke hate, is racially or ethnically inappropriate on or through Anytime Astro. Posting, uploading, transmitting, or making available this type of content in any way on Anytime Astro is prohibited.
4. You are prohibited to engage in any acts which may defame Anytime Astro or harm its interests. You must not post any defamatory remark or review about Anytime Astro on any social media platform. You are prohibited to share the policies of the company with anyone else or give negative remarks about staff, officers, directors, agents, consultants, or those who are affiliated with Anytime Astro. It is agreed between the parties that you will not prompt, persuade, encourage any of your acquaintances, customers, or family members to do the same. If found violating this clause, your profile will be deactivated.
5. By signing up on Anytime Astro, you agree to decently reply to all kinds of reviews or comments posted by the customer targeting you. You are prohibited to make public the personal information of your customers you found through Anytime Astro. In any case, you must not disclose the reason why the customer sought advice from you or any other confidential data of the customer revealed to you during consultation.

Personal Information

1. You agree not to disclose any private information concerning yourself, your acquaintances, family, friends, or anyone else irrespective of whether they are connected with you or not. This private information may include but is not limited to personal contact numbers, details of bank account, e-mails, websites, blog posts, social media profiles(Facebook, Instagram, WeChat, Whatsapp, Telegram, etc.). You are prohibited from sharing personal data with customers who are consulting you. If found violating this clause, your profile will be deactivated permanently.
2. You agree not to demand any funds for a free service provided by you in any case.
3. You are not permitted to demand the customers to submit money in your personal account for services offered through Anytime Astro.
4. You agree not to misuse any customer information or share directly or indirectly your personal data with the customer. If found violating this clause, your profile will be deactivated permanently.
5. Your account will only activate if the compliance team finds you clean after the investigation of your conversations (which includes chats, texts and phone conversations) with the customers otherwise your profile on Anytime Astro will be permanently deactivated.

Direct Contact Prohibition:

1. You agree not to receive the contact information of any customer seeking your consultation and influence them to consult you personally for your personal gains.
2. You are required to convey to customers of Anytime Astro seeking your advice to ask any questions only on the portal of Anytime Astro. You must inform them to avoid sharing any personal information on phone calls/chat consultations.
3. If in any situation, you are obliged to refer any other Astrologer present on Anytime Astro to the customer, you must only share that Astrologer’s Anytime Astro ID and Name. You must not share any other information about that Astrologer. This personal information includes but is not limited to a contact number, email address, personal website, social media profiles( Facebook, Instagram, etc.).
4. You agree not to use any customer information shared with you during consultation or contact through Anytime Astro. This personal information is inclusive of contact number and you declare that you will not use it to approach the customer directly without the knowledge of Anytime Astro for your personal benefit. If found violating this clause, your profile will be deactivated.

Genuine Astrology Services:

1. In any case, Anytime Astro does not support or promote superstitious activities like Tantra, Black Magic, Tona Totka, Vashikaran, etc. Astrologers are required to provide only practical and simple remedies to customers during consultations. Any advice which is relatable to endangering the life of any human being or animal or related to any loss will be considered a gross violation by Astrologer.
2. You are prohibited to defame or disrespect any other Astrologer listed on Anytime Astro while offering your services to any customer on Anytime Astro. You agree not to humiliate any other Astrologer by delivering negative remarks on them like they are incapable, inefficient, less skilled, etc. Such violation will be considered very grave and a temporary deactivation may be applicable on you.

Misusing Credentials provided by Anytime Astro:

1. You agree and declare not to share Anytime Astro credentials provided to you to anyone. The system of Anytime Astro obtains data through your IP Address. If found violating this clause, your profile will be deactivated.
2. You agree and declare to not share personal account details made on Anytime Astro to anyone. You must not dupe your customer by providing them consultation through anyone else impersonating you. If found violating this clause, your profile will be deactivated followed by an imposition of criminal liability.
3. You are prohibited to impersonate any person including fellow Astrologer on Anytime Astro or any entity, guide, or falsely state or misrepresent your affiliation with a person or entity on other portals.
4. If found violating the above clauses, your profile will be deactivated. Moreover, the green badge on your profile will also be removed.

Predictions:

1. In any case, Anytime Astro does not support providing predictions on sensitive topics which may prompt unmindful choices being made by the user/customer. You are prohibited from advising users about the following topic or any other situation which may influence the customer to commit any offense.
You are prohibited to predict:-
• The gender of the child to be born.
• Exact date/ time for medical issues such as the success of the operation on any particular date.
• About any criminal offense being planned by the user.
• About gaining profit through illegal means.
• Related to gambling, money laundering, drug abuse, etc.
• About death for any reason including medical, accidental, etc.
If found violating this clause,there will be permanent profile deactivation. It is agreed between parties that your profile will be black-listed and you will no longer be able to contract with Anytime Astro in any manner in the future.
2. You agree that if any case including internet issues, wrong predictions being made, technical glitches, or the customer is not satisfied with the service provided, you will be required to refund the amount to the customer voluntarily and will inform the same to Anytime Astro. If found violating this clause, Anytime Astro reserves the right to refund the customer.
3. It is agreed between the parties that all your chat and call conversations with the customers will be duly recorded for quality reasons. Anytime Astro may choose to monitor such conservation without informing you about the monitoring reasons.
4. You agree that you will provide only the genuine answers to the customers and will not copy and paste data from other websites and apps. You will be required to deeply analyze the issues and charts of customers and then compose and type all the answers by yourself. If we find that your answers are copy-pasted or we receive any complaint of poor report quality, immediately a refund will be processed to the customer, also this will lead to the removal of the green badge.

USAGE OF FEATURES

Anytime Astro Verified Green Badge:

For getting a verified Green badge, you will have to be available on the website for a minimum of 100 hours every month. The green badge shall be liable to be removed in case you are found violating any terms and conditions mentioned in the Terms of Use.

Reviews

Customers can provide reviews for the services provided by you to them. These reviews can be positive or negative depending on the service delivered by you. You cannot force the user to provide a good review/rating for your services. You are prohibited to delete or remove any review submitted by a customer. If for any genuine reason, you wish to make changes in the reviews, a request needs to be submitted to the admin and suitable action will be taken if required.

Pricing

1. You agree that Anytime Astro holds the sole and absolute right to control the price changes which can be modified as per our discretion without any prior notice.
2. As per our payment terms, you agree and declare that from the amount paid by the customer to render your services through Anytime Astro, 60 percent will be acquired by Anytime Astro and 40 percent will be deposited in your bank account provided by you subject to any kind of offer including buyback, promotional schemes, discounts, etc. presented to the user. Notwithstanding anything mentioned above, the amount required to be paid to you for sessions where customer booked consultations applying promotional offers, shall be proportional to the offering given by Anytime Astro in either 40 percent or less subjective to the amount deducted due to the promotional offer given to the customer.
3. You agree and acknowledge that you will be paid between the 7th to 15th of every month, i.e. in the second week of every month.

Profile Updation

You agree and acknowledge that your profile once verified by the compliance team on Anytime Astro cannot be changed unless the changes proposed by you are reverified. To request any change on the content or details of your profile , you are required to raise a ticket from the dashboard of Anytime Astro.

Feature Update

The features and functionalities provided to you on Anytime Astro can be altered or removed at any time. Once the feature is updated or any new feature is added, you will be notified of the same on the dashboard of the Anytime Astro application. Your continued use of the app and website will represent your acceptance of the updates made.

REFUND AND CANCELLATION

1. You acknowledge that any service received by you through Anytime Astro is chargeable. It is agreed between the parties that if any user seeks a refund for the amount paid for your services, the complaint shall be reviewed by the Administrator/Compliance team. If found genuine, a partial or full refund will be processed without seeking your approval. You agree that in that matter, the decision of Anytime Astro will be regarded as final. Once the refund is made, the same shall be from both the parties to this Terms i.e. You and Anytime Astro.
2. If any genuine complaint is raised from foreign users, they will be liable to receive back the amount paid on the payment gateway. You agree that if any refund is processed for any foreign user, the same shall be refunded from your account as well.
3. Notwithstanding anything in the above clauses, users will be eligible for a refund only for services delivered in the past 3 days from the date of request of the refund being made by the customer.

INDEMNIFICATION

1. You undertake to compensate, defend, and hold Anytime Astro, its affiliates and its employees, directors, officers, representatives, consultants, and agents (collectively called the “Indemnified Parties”), harmless from any kind of losses, suits, damages, expenses, judgments and costs (including reasonable attorneys fee and litigation cost) that arises out of or in regard
1. with any suit, action, claim made by you.
2. any unauthorized use and violation of your created and managed profile on Anytime Astro.
2. The indemnified party, before any claim is brought for indemnification, shall notify the other party of the proceeding, and deliver all legal pleadings and other documents reasonably necessary to defend the indemnifiable proceedings.
3. If the indemnified party fails to notify the indemnifying party of the legal proceedings, the other party will be relieved of its indemnification obligations to the extent it was prejudiced by the indemnified party's failure.

This section shall survive the termination or expiration of this Agreement.

GOVERNING LAWS

1. The above-mentioned terms and disputes that arose out of them will be governed by Indian laws.
2. The exclusive jurisdiction to entertain and determine any dispute arising between You and Anytime Astro will be decided at courts situated in Jaipur.

DISPUTE RESOLUTION

1. Disputes arose in these Terms and the Website will be resolved at first instance by the modes likes Arbitration, Mediation, and Conciliation.
2. The arbitrator’s judgment will be considered final and binding on You and Anytime Astro.

SEVERABILITY

1. It is agreed between the parties that if as per a court of competent jurisdiction, any clause of these terms and conditions is held to be illegal, invalid, or unenforceable, the remaining provisions will continue to remain in effect and in full force.
2. Such provision being declared or determined invalid, enforceable, or illegal shall be removed from these Terms and will have no adverse effect on other clauses.

CONFIDENTIALITY AND NON - DISCLOSURE

1. You agree that you shall not disclose the confidential information of Anytime Astro to any third party and shall hold it in the strictest confidence. You are prohibited to use confidential information other than the use of the Website notwithstanding anything mentioned in these Terms. You agree that you shall not use the confidential information of Anytime Astro for any personal or third party gains.

INTELLECTUAL PROPERTY

Anytime Astro will be the sole owner of all the content generated and displayed on Anytime Astro’s website, apps, and other platforms inclusive of copies exchanged between customers and Astrologers. It retains all ownership rights. This section shall survive the termination or expiration of this Agreement.

OTHER GENERAL PROVISIONS

1. You precisely agree and understand that Anytime Astro, its affiliates, and any of the aforesaid officers, directors, sub-contractors, shareholders, agents, and employees shall not be answerable to any third party for any incidental, indirect, special, consequential, punitive, or estimable damages, including (but not limited to), loss of business, profits, revenue, data, use or other economic benefits).
2. You understand that neither party will be liable for breach of contract damages that are remote or speculative in nature or that the breaching party does not have foreseen or entry into these Terms because of genuine reason.
3. It is agreed between the parties that neither party may assign these Terms or any of their rights or obligations hereunder without the prior consent of the other.
